Jury Finds Orthopedic Surgeon Committed Medical Malpractice

A Wassau, Wisconsin jury found that an orthopedic surgeon had committed medical malpractice when he failed to diagnose a 67 year old woman’s traumatic dislocated shoulder. They awarded $600,000. The plaintiff’s attorney was Paul Scoptur, an experienced personal injury lawyer with primary offices in Milwaukee.

This case serves to illustrate that juries have the ability to separate out frivolous lawsuits from those that have real merit. We have relied on the jury system since the time of our founding fathers and attempts to place caps on medical malpractice cases is misguided. It only benefits the doctors and their insurance companies and does nothing to eliminate the countless uncessary injuries and deaths caused by medical malpractice.
